Terms of Use

Effective date: August 1, 2026

1. Acceptance of These Terms

These Terms of Use ("Terms") are an agreement between you and Thru Consulting LLC ("PixDay," "we," "us," or "our"). They govern your use of pixday.co, our online photo galleries, and our ordering services (the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy . If you do not agree, do not use the Services.

You must be at least 18 years old, or the parent or legal guardian of the student whose photos you are viewing, to use the Services and place orders.

2. Our Services and Your Access

PixDay works with schools to provide school picture day photos. After picture day, parents and guardians receive a private link or access code to view their child's photos, choose poses and backgrounds, and order prints or digital downloads.

You are responsible for keeping your gallery link, access code, and any account login private. Do not share them with anyone who is not authorized to view the student's photos. Tell us right away at help@pixday.co if you believe your access has been used without permission.

You agree to give us accurate information, including your contact and shipping details.

3. Orders, Payment, and Refunds

Prices and payment. Prices, packages, and any shipping or sales tax are shown at checkout. Payment is due when you place your order and is processed by our payment provider. By ordering, you confirm you are authorized to use the payment method.

Digital downloads. Digital files are delivered right after purchase. Because they are available immediately, digital purchases are non-refundable unless the file is defective.

Prints and products. Printed items are made to order. If your order arrives damaged, defective, or incorrect, contact us within [30] days of delivery and we will reprint or refund it.

Retakes. If you are not happy with your child's photo, contact us or your school about retake day options.

Fundraising. A portion of sales may go to your school as a fundraiser, as agreed with the school. This does not change the price you pay.

4. Photos and Intellectual Property

Photos in the Services are owned by PixDay or the photographer who took them. When you buy a digital download, you receive a personal, non-commercial license to use, copy, print, and share that photo, for example with family, on social media, or at a local print shop. You may not sell the photos or use them for commercial purposes.

Unpurchased gallery previews are for viewing only. Do not screenshot, download, copy, or remove watermarks from preview images.

The PixDay name, logo, website design, and software are owned by PixDay and may not be used without our written permission.

5. Acceptable Use

When using the Services, you agree not to:

  • Access or try to access photos of a student you are not authorized to view
  • Share gallery links or access codes with unauthorized people
  • Use the Services for any unlawful, harmful, or fraudulent purpose
  • Copy, sell, or commercially use photos beyond your license
  • Hack, reverse-engineer, scrape, or interfere with the Services or their security
  • Upload viruses or other harmful code

We may suspend or end your access if you violate these Terms.

6. Disclaimers and Limitation of Liability

Disclaimer. The Services are provided "as is" and "as available." To the fullest extent allowed by law, PixDay makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted or error-free. Screen colors may differ slightly from printed products.

Limitation of liability. To the fullest extent allowed by law, PixDay will not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim related to the Services is limited to the amount you paid PixDay for the order giving rise to the claim.

Indemnification. You agree to indemnify and hold PixDay harmless from claims arising from your misuse of the Services or your violation of these Terms.

7. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Morris County, New Jersey, and you consent to their jurisdiction. Before filing a claim, you agree to contact us first so we can try to resolve it informally.

8. Changes and Termination

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. Continued use of the Services after changes means you accept them. We may suspend or discontinue the Services, or your access, at any time. Sections 4 and 6 survive termination.

9. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and PixDay about the Services.
